🇺🇸 Maine voted 75% to ban superPACs and the case is now one appeals ruling from a shot at the Supreme Court... the lawyer who argued down Trump's tariffs is carrying it
The target is a 2010 lower court decision called SpeechNow, which is what created superPACs two months after Citizens United, and that distinction is the whole case.
Harvard law professor Lawrence Lessig says it lets the justices keep Citizens United intact and still kill unlimited money:
"You can say Citizens United was completely correctly decided, but nothing in Citizens United means we have to have superPACs."
Billionaires went from 0.3% of outside money in 2010 to 19% in 2024, and the first Trump voter Lessig met in Maine signed the petition and spent the day signing up every Trump voter who walked past, so if the First Circuit moves fast, 2028 could be the first election without them.
